To fulfil the obligation arising from Articles 13 and 14 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter: GDPR), in connection with Article 88 of the Act on the principles of implementing tasks financed from European funds in 2021–2027, we hereby provide information regarding the processing of your personal data.
Personal Data Controller
The Controller of your personal data is the Minister of Development Funds and Regional Policy, in the scope in which the Ministry acts as the Managing Authority of the European Funds for Smart Economy Programme (FENG), with its seat at ul. Wspólna 2/4, 00-926 Warsaw, Poland.
The Controller obtains personal data directly from you or from entities involved in the implementation of the European Funds. The provision of your personal data is mandatory if you wish to benefit from the European Funds, or if you are an applicant, a beneficiary, or a representative of a beneficiary.
Purpose of Processing
Your personal data will be processed in connection with the implementation of the European Funds for Smart Economy Programme (FENG). Providing your personal data is necessary for the implementation of the Programme. Refusal to provide your data will result in the impossibility of undertaking the relevant actions.
Legal Basis
Your personal data will be processed because: - we are required to do so by law (Article 6(1)(c) GDPR), or we perform tasks carried out in the public interest or in the exercise of official authority vested in the Controller (Article 6(1)(e) GDPR). These obligations arise from, among others:
- Regulation (EU) 2021/1060 of the European Parliament and of the Council of 24 June 2021 laying down common provisions on the European Regional Development Fund, the European Social Fund Plus, the Cohesion Fund, the Just Transition Fund and the European Maritime, Fisheries and Aquaculture Fund, as well as financial rules for those funds, and for the Asylum, Migration and Integration Fund, the Internal Security Fund and the Instrument for Financial Support for Border Management and Visa Policy,
- Regulation (EU) 2021/1058 of the European Parliament and of the Council of 24 June 2021 on the European Regional Development Fund and the Cohesion Fund,
- Regulation (EU, Euratom) 2018/1046 of the European Parliament and of the Council of 18 July 2018 on the financial rules applicable to the general budget of the Union,
- the Act on the principles of implementing tasks financed from European funds in 2021–2027,
- the Act of 14 June 1960 – Code of Administrative Procedure. We prepare and perform contracts to which you are a party and the processing is necessary to conclude and execute such contracts (Article 6(1)(b) GDPR).
Categories of Personal Data
We may process the following categories of your personal data:
- identification data, including in particular: first name, surname, job position, contact details (e-mail address, telephone number), internet identifiers, place of work, and in some cases also PESEL (personal identification number), NIP (tax number), REGON (business registry number),
- data related to the scope of participation of natural persons in the project, including in particular: form of involvement in the project, remuneration received and working time,
- 3. data of natural persons appearing on documents confirming the eligibility of expenditure, including professional experience, construction licence number, ID card series and number,
- 4. data regarding the image and voice of individuals participating in events related to the Programme, data may be obtained directly from you or from institutions and entities involved in the implementation of the Programme.
Recipients of Personal Data
Your personal data may be entrusted or disclosed to:
- entities to which we have entrusted tasks under the European Funds for Smart Economy Programme,
- the Audit Authority, referred to in Article 71 of Regulation (EU) 2021/1060,
- institutions of the European Union (EU) or entities entrusted by the EU with tasks related to the implementation of FENG,
- entities providing us with services related to the operation and development of ICT systems, as well as ensuring communications, e.g. IT solution providers and telecommunications operators.
Data Retention Period
We will store your personal data in accordance with the provisions on the national archival resource and archives, including for a period of at least 5 years from 31 December of the year in which the last payment to the Programme’s beneficiary was made, subject to provisions that may provide for a longer period of control, as well as provisions on State aid, de minimis aid, and value added tax.
Your Rights
You have the following rights:
- to access your personal data and receive a copy of it (Article 15 GDPR),
- to rectify your personal data (Article 16 GDPR),
- to restrict the processing of your personal data (Article 18 GDPR),
- to object to data processing if it is based on Article 6(1)(e) GDPR (Article 21 GDPR),
- to lodge a complaint (Article 77 GDPR) with the supervisory authority, i.e. the President of the Personal Data Protection Office, ul. Stawki 2, 00-193 Warsaw, if you consider that the processing of your personal data violates GDPR or other provisions on personal data protection.
Automated Decision-Making
Your personal data will not be subject to automated decision-making, including profiling.
Transfer of Data
Your personal data will not be transferred to a third country or an international organisation other than the European Union.
